You may use the Travely Platform to discover places, read and write reviews, and share travel experiences. By accessing our Platform, you agree to:

• • Be at least 18 years old or have parental consent if 13-17 years old
• • Provide accurate and complete information during registration
• • Use the Platform only for lawful purposes and in accordance with these Terms
• • Respect the rights and property of other users and the businesses listed on Travely

To access certain features, you must create an account. You are responsible for:

• • Maintaining the confidentiality of your login credentials
• • All activities that occur under your account
• • Immediately notifying us of any unauthorized use
• • Providing accurate, current, and complete information
• • Updating your information to keep it accurate and current

We reserve the right to suspend or terminate accounts that violate these Terms.

You retain ownership of content you submit (reviews, photos, listings), but grant Travely a worldwide, royalty-free license to use, display, and distribute your content. You agree that your content:

• • Is accurate and not misleading
• • Does not violate any third-party rights
• • Does not contain offensive, discriminatory, or illegal material
• • Does not include spam or unauthorized commercial content

We may remove content that violates these guidelines without notice.

Travely offers two paid products: prepaid travel eSIM data plans and the Travely Pro ad-free subscription. All payments are processed through secure third-party payment processors. By making a purchase, you agree to:

• • Pay all charges incurred by your account
• • Provide current and accurate payment information
• • Auto-renewal terms for the Travely Pro subscription
• • Our refund policy as outlined in our Refund and Return Policy

Prices are subject to change and are shown before you confirm a purchase. Currency conversion fees may apply for international transactions.

The Travely Platform, including its design, functionality, and content, is protected by intellectual property laws. You may not:

• • Copy, modify, or distribute our proprietary content
• • Use our trademarks or branding without permission
• • Reverse engineer or attempt to extract source code
• • Create derivative works based on our Platform

All rights not expressly granted are reserved by Travely.

The following activities are strictly prohibited:

• • Using the Platform for illegal purposes or fraudulent activities
• • Impersonating others or providing false information
• • Attempting to gain unauthorized access to our systems
• • Distributing malware, viruses, or harmful code
• • Scraping or harvesting user data
• • Interfering with Platform functionality or security
• • Violating applicable laws or regulations

Violations may result in immediate account termination and legal action.

Either party may terminate this agreement:

• • You may delete your account at any time through account settings
• • We may suspend or terminate accounts for Terms violations
• • We may discontinue the Platform with 30 days notice
• • Certain provisions survive termination (payment obligations, intellectual property)

Upon termination, your right to use the Platform ceases immediately.

Travely is provided "as is" and "as available" without warranties of any kind. We disclaim:

• • Warranties of merchantability and fitness for a particular purpose
• • Guarantees of uninterrupted or error-free service
• • Responsibility for third-party service provider performance
• • Accuracy of user-generated content and reviews

Use of the Platform is at your own risk.

To the maximum extent permitted by law, Travely's liability is limited:

• • No liability for indirect, incidental, or consequential damages
• • Total liability shall not exceed the amount paid by you in the 12 months prior to the claim
• • No liability for third-party actions or service provider failures
• • No liability for data loss or security breaches beyond our control

Some jurisdictions do not allow limitation of liability, so these limits may not apply to you.

These Terms are governed by the laws of Delaware, United States, without regard to conflict of law principles.

• • Disputes will be resolved through binding arbitration
• • Arbitration will be conducted under AAA Commercial Arbitration Rules
• • Class action lawsuits are waived
• • Injunctive relief may be sought in state or federal court

If any provision is unenforceable, the remainder of these Terms remains in effect.
